Woman Asked To Leave Mall Because Of Dress

I know this isn't exactly politics, but I figured I'd post it here since all threads started in this sub-fora seem to need Mod approval.

I'm mildly curious about this case in terms of individual rights, property rights, etc., but I'm mostly curious about how that gal expects to be able to sit down in public wearing something like that. Looks to me like it would ride up to about her belly-button. (There're pictures of her modelling the dress at the link.)

Woman Asked To Leave Mall Because Of Dress

Kymberly Clem, 20, says she walked into the Richmond Mall Saturday but was soon escorted out all because of her dress.

"I was walking through and 10 minutes after I was there, the security guard approached me, asked me to step aside, made me completely do a turn around while he stared me up and down and then asked me to leave because my outfit was too provocative and people's husbands was (sic) looking at me," says Clem.

Clem says she bought the dress at the mall just the day before. She says she's worn more revealing clothing before to the mall, but this is the first time she's been kicked out.

Clem now wants answers and says she's been wrongly turned away.
27 NEWSFIRST tried contacting the Richmond Mall for comment, but those requests were denied.

There's no word yet if Clem plans to pursue any action against the mall.

I wonder how the Richmond Mall Guard spells "Flavour?"

Actually that is not true. There seems to be a bug in the vBulletin software, that causes this approval issue. I have seen it even in posts without links or a possibly offensive word. Hopefully the upcoming update will deal with the bug(s) that cause this issue.

This could be a very interesting case.

Surely there are some bylaws into force, which may have been contravened by wearing this in public. However, if that is the case, would it not be more or less illegal to sell a good for a purpose for which it can't be used??

she has a good point, people wearing clothes that may offend religion or even sexist t-shirts etc can be worn, but her dress doesnt suit the security guard so he sends her home? i think he had a "fatherly" moment and probably thought "i wouldnt let my 20year old daughter wear that in here with all these men around" and so acted in what may have been good natured in his mind, but obviously not in hers and many other peoples

Re: Woman Asked To Leave Mall Because Of Dress

It would seem she was reported from others that were offended considering she said

"asked me to leave because my outfit was too provocative and people's husbands was (sic) looking at me"

She also states that she's worn more revealing clothes in the past (I'd like to know HOW) So this is probably the first time they've had complaints.

Malls are private property- they do not have to offend others to cater to the whims of one.

As to her buying that "dress" in the mall. The dress does not fit ANY current fashion that I'm aware of except a bathing suit cover up. Seriously- look at the back straps on it and the print.

If she bought a T Shirt and wore it without pants she would have been asked to leave too.

I don't understand this! SOOOO many young and even older women wear very low cut tops and very tight short shorts and they are everywhere, men looking while driving, walking, or just standing there admiring the scenery (if you catch my drift). Why is this made into a big deal?

Why wasn't the Security Guard checking for Security? I'm sure that dress showed she had nothing to hide. C'mon...Really!

Where would she actually hide anything???

Insecurity...probably wanted that dress for herself!

Seriously, though, that is a good question. I have several scenarios in mind but don't have time to post them.

Re: Woman Asked To Leave Mall Because Of Dress

I doubt seriously that the security guard was acting on his own. He is employed by the owner or operator of the mall. That owner operator will have to be responsible for the legal aspects of the girl being asked to leave.

If the guard was acting on his own or by the request of the malls customers as seems to be the case, he is wrong and should have gotten the concurrence of the mall owners before acting. He may also be liable for any civil suit that arises as the result of her complaint. All this depends of course upon the laws of the state in which this all occurred.

One argument the girl makes is bogus and should have been left out of her complaint.

Purchasing the dress at the mall does not give one a license to wear it anywhere she wishes at the mall or anywhere else.
